My exhusband gets to claim our oldest daughter, I do not beleive he is doing so. He is the type to lie either way about the answer just to upset me. I was wondering if there was a legal way to find out if he has, and what are my options?

Why would he not claim her if he could? It's a substantial deduction. If he can I am 99.9% sure that he will. If he won't tell you, then you can tell the judge that did your custody.

Hey Jodi-Mesa, He's not a very bright person when it comes to this. He is an ex for a reason, not to be too sarcastic. Our tax rep who prepairs our taxes is asking because if he has not claimed her then we can go back for up to five years and claim the taxes he has not. He can be quite the jerk. I just didn't know if there was a way of finding out without spending alot of time in court over it. Thanks.

Wow - I wish I had a definite answer for you - I like the "he's an ex for a reason" we've all been there right. You might be able to get his past tax records from the IRS, but I imagine you would need a court order to do so. Tax preparers have tighter privacy laws than the military, lol. I'll see if I can find anything else.

Yeah with the 1040X you can go back and collect all of those credits.

Is there anyway that you can talk to his relatives to find out?

I have tried to get some info from the family that is in contact with him, he's a bit of an outsider in his family. I'll try to check with the IRS, maybe I'll get lucky. I want to thank you for your time and concern, It means alot. I like the pic posted, you two look very happy. Hope all goes well for you. Thanks again.
