If mold is present and harmful to my health what is my landlords responsibility?

I rent a town home in omaha, NE and the ownership of the property changed in may. I have had a difficult time getting the landlord to make necessary repairs and so to be sure I purchased a mold kit from work took two samples one from under kitchen sink and laundry room sent it in with the $30.00 lab fee and recieved the results today stating there are 4 types of mold all capable of causing lung diseases and irritation to anyone with pre exisiting respitory conditions which my 5 yr old son has had asthma since he was 2 mo old. what are my rights and what is his responsibility as well as the time frame he must take care of said problem?

You can take the owners to samall claims court and also ask for any money that you have had to pay for any sickness for you or your children. You need just to be sure that you take a copy of the letter you got back stating the information on the mold. You also need to send the landlord a certified letter stating that he needs to fix the problem ASAP because it is causing you and the children to be sick. That your child has asma. Keep a copt of that certified copy. You can also give them a thirty day notice even with a lease if they refuse to fix the problem, that is why this is so imporant that you show the court that you have done everything a tenant can do to resolve the problem. you can also ask for the 30.00 dollars that you had to pay for the test. By the way that was a very smart move you made doing that.
