Is this discrimination?

I have a friend "Bob" who was recently offered a job with the city. Today, the offer was recinded. The reason? Bob was accused of lying on his application. When Bob was 19, he had a 17 year old girlfriend. They were intimate. Since he lived in a small town this was public knowledge. No one pressed charges, he was not charged with a crime, he has no criminal record. Fast forward several years. Bob applies for a job with the city he grew up in. When asked on his application "have you ever committed a sex crime?" he answered no. Since the person hiring Bob knows of his past, it is his interpretation that Bob lied and had committed a sex crime. If Bob has no criminal record and was never charged with a crime, can the city accuse him of lying on his application?

Wow, that is a really good question that "Bob" has.

If "Bob" has never been charged of a legal crime, regardless when and who and how often he had sex with his girlfriend at the time, then it isn't really a crime. And it isn't lying.

If this guy at the place "Bob" was applying thought he was lying about this it may be worth bringing it to a lawyer or at least talking to one. You would have to prove things like that is the reason you were disqualified for the job, and that the person in charge new about "Bob" prior relationship and how in his mind must have been illegal or something.

I'd go find a lawyer and talk with them. Most lawyers I think offer a free consolations.

I would think no. He should be able to have his record brought up. The person is alledging because of proir knowledge. The proof is his record if its clean. The facts speak for themselves.

now based on all of the drama going on the city may not hire him based on that, but I do believe it's illegal for this person to alledge anything.

A free consultation with a good lawyer will give you an idea if there was a line crossed.

Also let "bob" know that his situation happens. I knew a guy that dated his high school sweet heart but they first dated when they she was 15 he was ( he was held back a grade and was 17, so when he turned 18 he had to hide the relationship due to laws. even though they were only 2 years apart.
