Misrepresentation

How would a person go about filing suit against an attorney who misrepresented them in a divorce case?

I would get a new lawyer. Go to www.findlaw.com search misrepresentation and pick your state. You may get a suit out of it.

I am unable to financially continue my legal battle with my ex, so a new attorney is out of the question. my actual question is in regard to the attorney i just fired. i paid her an upfront 3,500.00 retainer. after 16 months not so much as filing a motion for mediation. she billed me an additonal 2,000.00 for 64 emails, and i know there were'nt even 1/2 that amount. does she not have to provide me with copies of each email interaction? i do not beleive i should have to pay a penny as she did absolutely nothing to bring resolve to my case. i want to file a motion to prove she is not entitled to receive payment. is there any such document i can file?

You might be able to. I don't know enough about that type of situation to give much advise. She has to show you everything regarding the case - thats what your paying her for. Sounds like you can get her for some type of misrepresentation (which can get her disbarred if severe enough). If you are going through trial now I would contact the judge doing your case and explain your lawyer problem. He may be able to put everything on hold until this is taken care of. You may not need to hire another lawyer, just do a free 30 min consult with one asking the same thing. You may even find one that will let you pay after you get your money back from the first one. Depending on your state, contact your local city gov. Where I live the city has a group of lawyers that provides free legal advice every 1st Tuesday of the month, but they don't really advertise it.

Every state has an ''ethics'' committee to monitor the elusive lawyer gone bad. Write a letter to them about your misrepresentation. Under law sh or he must respond. Lawyers do not like being in the spotlight when it comes to their so called''ethics''. I did it...The lawyer was threatened with suspension if she did not appear with me...I did win!
