There is no time limit on changing the name on a birth certificate in Virgina. Virginia code 8.01-217 How a name of a person may be changed. Any person desiring to change his own mane,or that of his child may apply to the circuit court of the county or city in which the the person whose name is to be changed resides. In case of a minor who has both parents living the parent who does not join in the application shall be served with reasonable notice of application and should such parent be held to determine whether the change of name is in the best interest of the mimor. Thabks for responding. My question may not have been clear. I am sorry. This is the situation. The childs mothers name is one name and the childs is different and she changed the babys name after she was born. And it is not my husbands name. IT is of her boyfriend and he was ruled out to be the father. My husband turned out to be the father. So if the boyfriend signed the paper saying he was the father does that mean anything. I know in Georgia that the mother has 60 days to do the paternity test and if she goes beyond that then whom ever signed the paternity papers is legally the father. So I am just wondering what and if there is any laws in Virgina.
