Paternity

My husband had to go June 5th to do a paternity test to find out if he was the father to this child from 2 years ago and we just got the results and he is the father. My question is the mother and the child are from Virgina and the mothers last name is House and the childs is different and its not my husbands name, my question is there a law in virgina for a certain amount of time and the name changing that she did after the child was born. In georgia they have 60 days.

There is no time limit on changing the name on a birth certificate in Virgina. Virginia code 8.01-217 How a name of a person may be changed. Any person desiring to change his own mane,or that of his child may apply to the circuit court of the county or city in which the the person whose name is to be changed resides. In case of a minor who has both parents living the parent who does not join in the application shall be served with reasonable notice of application and should such parent be held to determine whether the change of name is in the best interest of the mimor. There is to much to write so it is better that you go online to the web site at. www.namechangelaw.com/ when the web comes up you will see a map click on Virgina and you will see all the information that you need to apply for the name change.

Thabks for responding. My question may not have been clear. I am sorry. This is the situation. The childs mothers name is one name and the childs is different and she changed the babys name after she was born. And it is not my husbands name. IT is of her boyfriend and he was ruled out to be the father. My husband turned out to be the father. So if the boyfriend signed the paper saying he was the father does that mean anything. I know in Georgia that the mother has 60 days to do the paternity test and if she goes beyond that then whom ever signed the paternity papers is legally the father. So I am just wondering what and if there is any laws in Virgina.
