Residential Lease Agreement

My wife and I, Her Sister and Brother-in-law just signed a 1 year lease agreement and unfortunately are in a big disagreement and they are talking about moving out. Can a lease agreement be broken without a big legal problem with the landlord? What would happen if they moved out on us and left us holding the bag? This agreement was with California Association of Realtors. We do not want to move, but I feel they are so upset with us that living with them will be very bad. Should I talk to the landlord about this? Please help, Dave Green

It sounds like you are in a rough situation. If your name is on the lease, you can't break it or you may have to pay in full your portion of the rent and any consession you may have received. Now, you should talk to your leasing agent to see if there is something that can be done. Some leasing agnecies will allow you to sublet the apartment, that is find someone else to live there in your place. If the inlaws say that you can move out and they will assume the lease themselves, then talk to the leasing agency to see if they can get a new lease with your names not on it.

What ever you do, don't move out with your name still on the lease. If the inlaws decided to not pay rent, you would be liable for what they owe if your name is still on the lease.

My mother signed a one year residential lease in Colorado. The term was from May 1st thru April 30th, 2009. She has paid her May, 2009, lease payment at the same amount as the Lease Agreement states. Now the Lessor wants to increase her Lease payment amount beginning June 1st. She notified my mother by phone, not in writing. Also the previous Lease Agreement does not address continuation of the current lease in any manner.

Does the Lessor have the right to increase the rent amount if she has accepted the payment in May 2009 for the same amount as the previous year?

Does the Lessee have the right to assume that the Lease payment would remain the same for the next 12 months?
