Retailer caims a deposit is non refundable

An event was scheduled for 6/6/09 with a florist. A $100 were given for deposit. Now they refuse to give the deposit back because they claim that it is none refundable. I'm asking for the deposit because I'm cancelling in advance.

Sounds like the florist is betting you won't want to spend the money (usually $50) or take the time to take him to small claims court. You could talk to the owner if you haven't already. Otherwise you could surprise him & go to court after taking out the complaint. If he doesn't take time out to show up in court, you'd get a default judgment in your favor for $100 plus court cost.
