Rules on family eviction in virginia

Live on family farm in house blt. for me. Mother told all family, nieghbors house is early inheritance. I am only heir. No rent, no deed, section not surveyed off. Have lived there for nearly 10 years. In dispute with Mom, age 80. Probably little dementia. Have family willing testify to harassment and earlier statements of early inheritance. She states now want to evict. Land in father's family for generations. Land hers through joint survivorship of father's deeds. Mom very disliked for years by most in community. Will she have go through regular eviction proceedure to get me out? Also, plan to file for harassment if she does. Drives through yard, intimidation, beating on windows and doors. Will also try file for diminshed capacity-- lot of evidence, threatened to burn house down. Police called. On a voice mail & deputy heard. Comm. Attory. decided not to pros. due to her age. Nitroglycerin in bird feeder, etc. Any suggesstions?

Unfortunately, you have no case using the prior promises of your inheritance. Since it was never a contract, there is no law on your side of that argument. She will have to go through the same legal steps for eviction and that could take at least 45 days, so she may change her mind in the meantime. If she doesn't and does go that far, then I don't think you would have many grounds for a harassment suit on her either. However, if you can prove the dementia, you need to get a court order for diminished capacity. Not only because it would help YOU, but also to protect her from someone who could try to take advantage of her.
