How long do you think he is going to be in jail? The only one that can stop or change a child support order is the court. The child support services will be adding all payments that you do not make into back errears and you do not want that. I would continue to pay, if the child ends up not going back home then you might want to file a motion with the court to ask for the payments to be stopped, however the state would then prusue you and the mother for support and believe me you will be paying more, so you better hope he gets out. You also have the option to consider if you think that it would be in the childs best interest to live with you, the mother and you can agree and file that agreement with the court, then your child support will end and you can help your son at the same time, its just an option that you have if you chose to prusue it.
