Time Restraints?

Original divorce decree (1996) had no stipulations for college expenses. We both remarried in 1998, she to the man she left me for. Support was modified 1999 as I was making less money than in previous years. She filed petition to modify in 2002- it was responded to, then the petitioner never followed through. In 2006, she and her lawyer mailed us a letter stating they believed I was making more money and that the amounts set in 2002 were lower than they should have been. I hired an attorney, we responded to letter with proof of wages for the years in question. Again, nothing further was pursued. 2008, petitioner is trying to use 2002 file to ask court to award monies for college expenses and pay the student loans - for one child, already out of college + monies for an already received Master's degree and expenses for another that will finish a 4 year degree (after more than necessary time) this winter. We were never approached or consulted to help with these expenses while they were being incurred nor were we consulted on the purchase of two, brand new vehicles, one for each child when each began college, that she also wants me to pay for as well.
She and her lawyer are claiming, again, that the appointed amount of child support was not enough and wants monies for what it should have been for the last six years. Oldest turned 18-2001, another in 2003. I have continued to pay the appointed amount for 4 children (2 in High School) since directed in 1999. Is this legal?

I am not an attornry and every state has different laws but I think something doesn't sound right. Why would your ex think she would be entitled to any money other than what was stated in the divorce degree. She is trying to get more money as they say after the fact. If you had know stipulation in your divorce degree then you should not have to pay any of the college. Futther more if the children got student loans they have agreed to pay it back or they would not of got it. Your name is not on the student loans right? You are not responiable for their cars either. It sounds like she is trying to take you for a ride. Get an attorney if a judge would make you pay all this I would really lose my faith in the court system. Good luck keep your faith i do not believe they have a case.

Thanks for your thoughts and comments. I am an underground Coal Miner and a Union Leader. I have been involved in many arbitrations and also believe what she is attemping to do is just wrong. I would have had no problem paying on kids collage if it had been done properly and not after the fact, however whan I am done with child support on 2 younger children in 2011 I intend on helping with 2 older kids student loans. Again THANKS
