What are my and my childrens' visitation rights?
I am in Texas and my children are currently in California with a paternal aunt who has recently been granted joint conservatorship of my children. Originally they were with C.P.S. since last July. On Oct. 9th the boys' Father and I were in a serious auto accident in which their father passed away, and I was comatose. The day of the accident we were on our way to have visitation with them, but obviously never made it. So I haven't seen my boys since Sept. 25th. Their aunt told me their counselor thought it would be to traumatic for them to see me, however I feel it is more traumatic on them and myself not seeing each other for nine months! They were able to go to their fathers funeral, but when the left for CA I was still in a coma. We get to speak every other Friday, But I miss my babies, I just want to hold them!They are all boys ages 16, 11, 9, and 6. Please help me! I am having a hard time without them. After speaking to the Aunt myself I do not believe necessarily that the counselor said no I think she is worried about them seeing me and wanting to stay with me and therefore having trouble dealing with them after the visit. But I feel as long as I have the proper mindset they will be fine. I'm working on getting them back asap, but I am still working on getting better after being hospitalized for two months.
