Every State has different civil lawsuit procedures and each in its own has limits as to injuries and negligence standards. There is no set dollar settlement amount, that is even if the case is settled at all. Each case has individual specific causations, evidence, thresholds of injury and cannot be clumped together as a number. If one searches on the State Court Sites of their own specific State, they may be able to look into similar cases and what has transpired as to Court, trial, and or mediation process if possible. It is always prudent to have legal counsel representation throughout the litigious process. But remember the attorney receives a portion of the "settlement" when and if there is one and or trial decision in favor of Plaintiff or injured party.. Personal Injury fee is usually 1/3 of the offer and settlement and fees incurred during the litigation process.(filing fees, court fees etc.) Hope this helps.

There are no average settlements in slip-and-fall cases, because they are dependent upon many variables, not the least of which is the difficulty in pursuing such cases and in doing so in certain states.

In Virginia, for example, many such cases do not even get out the gate, because the presumption is that the plaintiff has a duty to watch where he or she is going, AND the defendant has to know there is a problem and did nothing to mitigate it.

What are the fcats specific to YOUR case and in what state did you fall?

Well that all depends. The good old lobbyist are trying there best to create cap limits on liability. The medical industry has done this on payouts concerning malpractice. Good ambulance chasers can work miracles though. The minimum with a good lawyer would be from 10,000 to a Million. Higher payouts could range up to 1 to 20 million. It would have to be one hell of a slip and fall case. I know lawyers who could pull of 20 million though.

I will say, most never see the court room, as 99 percent are settled out of court.
