She will get a ticket for no isurance. but the other person will have to pay with his insurance . on his car. which in turn will have to pay for her car. shes just quilty of driving with out insurance!

The other person's insurance is trying to get money from me for the accident. Is that legal?
They can ask . but you tell them to take it to court and you will not talk to them again. tell them that its there drivers blame. any time you get hit in the back end. its the other persons blame. ive worked this when i was a cop. and all was done was to write a ticket to the unisur, driver. and if it was the others persons blame. thats where you put it. remember if you hit from behind. regardless. its the other persons. blame. no matter. dont matter if they are insur, or not. dont take the blame . for some thing the other person done.
The law states that you are not to be driving without insurance period. If the police would of been called you would of gotten a ticket for know insurance and your car would of been towed. If there was not enought damage to call the police then you would of only had to exchange insurance information and with you not having any you would of had to give your drivers licence. The person that hit you from behind is at fault,and the reason we have uninsured insurance is for people like yourself that drives without insurance so your lucky on this one. In some states people don't get the uninsured then you would be talking a whole different ball game. I think you should take the blame and be more responiable had you not been on the road without insurance this would of not happened.
