What options do I have to recover my losses from an accident?
On Oct 5th 2007 a 19y old ran into my tow truck and damaged my garage door and a car parked inside the garage. He was DUI. Since then his insurance company is giving my company the run around and low balling the estimate to repair the damages, not to mention the down time that it has been costing everyday without my truck. I am seeking $300.00 a day until my truck gets repaired . I have made several calls to the adjuster for his insurance company and I am treated unfairly or I just get ignored. Also he only has 10k worth of coverage. My damages and downtime far exceed that. I do have insurance but I don't think I should put a claim on my insurance for something we did not cause. My premium will increase substanialy and again will punish my company for something we did not cause. I am unsure on what I need to do. I need to see if I should hire an attorney or file some kind of lawsuit and if so what type and how. Since the damages only are property damages do I have any legal recourse at all to recover all of my costs?
