It depends. According to the new bankruptcy law, people with higher incomes cannot file chapter 7 (liquidation), and have to file chapter 13 (repayment) instead which mean you do have to pay a portion of the debt.

In order to file chapter 7, you must make less money than the average income for the size of your household. Do you have homeowners insurance on your house? That should cover you for an injury that occurred there.
