Father in prison, She lied!

April 24, 2007 my father turned himself into the police to began his sentencing for something that turned out to be a lie. My father was accused of molesting a minor that push herself onto him while he was sleeping. How do I know that this was a lie, because she confessed to her mother, my father's wife, family and friends. He was given a sentence of 30 years from one judge, then another judge came in and gave him the sentence of 3 yrs and I do believe 3 months. My question is, how do I go about getting him an appeal? How do I go about looking further into the trial, investigation and everything that got him that sentence, so that I can give them proof that he deserves to be home with his two children under the age of 2 yrs.? Do I even have a case? Could the young lady be charge? How do i go about looking into the trial and everything? Do I have a case? Can the yound lady be charge? How can the state help or hurt his case? Should his representative be held accountable?

For this situation, you really will need a lawyer if you think that he is innocent, but I have a hard time believing someone would confess to a crime that got them 30 years and will force them to register as a child molester if they did not do the crime.

If it is suspected that he molested this child, and he has 2 children under 2 at home, this could actually HURT his case because the prosecutors will probably bring up the safety of those children.

If the young lady is 16, 17, 18, they may be able to charge her as an adult but that is also unlikely.

If you really intend on appealing this situation, you will have to get a lawyer. Many lawyers now have a free consultation to see if you have a case or not, so it may be in your best interest to call around and find one that can tell you if you have a case or not.

Get the so called victim to say this on a tape recorder , with her consent, and get her to sign a paper saying she lied, with a witness, there watching her sign
