Medicare secondary payer rules

If a Medicare eligible employee opts out of employer's plan MC pays as primary. Will MC still go back to the EMployer and request refund because the Ee is ELIGIBLE for the plan or does Ee only have to be enrolled in Employer's plan for Er plan to be primary?
