How do I purchase a song that someone has written, but not recorded?

My band is looking at recording a CD of original music. I have a friend that has written a song that would be great for us, and I'm pretty sure he is going to do nothing with it. I would like to purchase the song and record it with my band as a part of our CD. What are the legalities of purchasing a song? What type of contract should be used to purchase a song? Does a mechanical license apply since the song has never been recorded or performed?

Hire an attorney and file the necessary paperwork to cover all parties involved. A royalty agrement sounds like the best course of action because if the song doesn't make you any money than he doesn't either. It gets more complicated. If you're serious about the music, hire an attorney if only to protect your friendship.
