Are you saying CPS took your nieces child away from her? If that is the case I asume that they placed the baby in your home. Where is the absent father? Is he unable to care for the child? Usally the other parent has the legal right to file for custody of the child. In any case if for some reason he cannot then you may want to have your niece sigh papers giving you consent to file for guardianship. However the absent father has to be sent notivacation of your intent that is the law. Being that CPS is involved means that something is going on with your niece thay do not just take a child out of a home without just cause. Not knowing anything about the father it is hard to give you any advice. However if he is in jail and has any promblems like your niece where CPS has been involved with him then I wouldn't woory about him being able to do much. I have been in this situration myself my daughter signed over papers giving me the legal right to file for guardianship. However CPS was not involved it was of her own choosing. It does not look like you have to much to woory about. Your niece is very lucky to have you to help her. Good luck
