Is that $130 per week or per month? If it is per month, you are one lucky guy and don't do anything cause you will never get anything lower. If that is $130 per week, you are getting ripped. Child support laws differ by state but generally are unfair and ridiculous. Some parents are deadbeats and don't pay a dime. They work "under the table" or have their own business and claim a loss on their business which is easy to do. I know of a guy who only pays $150 a month and drives a BMW and lives in a expensive home, but, because he owns his own business, he goes to court showing that he doesn't make any profits. The non-custodial parent with a regular job, like you, gets ripped off. The more money they make, the more they pay. My husband pays more than $900 per month for one kid. The custodial parent doesn't have to show where the money is spent or pay taxes on it. They can use it to buy drugs and alcohol if they want to and there is nothing you can do about it. Your options are: 1. File for custody of the child, 2. Get a better job (you will eventually have to pay more, but only if she goes back to court), 3. Get a second under-the-table job, 4. Quit your job, move in with your parents and go back to school

Do you have an order of child support though the courts? If you do you can always file for modification. The courts usally goes by your incom and they take up to 30%. You have to continue to pay if you have a court order until the court allows for the modification. Your wifes incom is not the issue,you will still have to pay child support. Being you are in two different states it is going to be more costly than if you were in the state that your wife is in. What are your and your wifes content for your relationship. Is there a chance you are both willing to work and rebuid your relationship or are either one of you thinking of divorce. You need to talk and decide what you both want. If it is a divorce than when you or she files than the visitation and the child support will be set up at that time. You might both want joint custody if you end up in divorce exspecially if your in another state My son got a divorce with joint custody and lived in another state he got the kids a week after school ended up until a week before school started and spring breaks and holidays. If you have not the money to file I would talk with my wife and it might be easlier to have her file if she does not make much money she can always contact free legal services,they go by your incom. If she is getting any kind of assitance though the state then they will pursue child support .
