What rights does my husband have

What rights does my husband have to child that he has never met ,seen or spoken to? recently an ex girlfriend from 16 years ago says he is the father and now he is ordered to pay child support when he was never notified of a hearing . how can we go about getting a paterinity test when we are a low income family with a new baby we need to support. he does want to meet the other child and be a part of his life he was absent because he was in prison for eight and a half years or he would have done anything for this child that is now said to be his

Anyone can name a person to be the father of their baby. The burden of proof is on the father to prove he is not. Even if your husband was in prision for eight and a half years that would not explain why she never let him know before he went in. Wouldn't the child be 16 now. your husband has the legal right to request a parterinity test they start at 150.00 and up. He may want to see if he can get help from free legal services. They go by incom although they do not take all cases. He might also want to try and get in touch with the childs mother and see if he can meet the child.If he feels at that time he still wants the test then he should pursue it. He will have to pay child support until the parterinity of the child is established.

You have to establish paternity. Period. Do the DNA test and go from there.

In addition I have access to very low cost paternity, which the Courts will accept, depending on which County your in.
