A document signed between you and your husband and notarized with a witness is more legal than not having it notarized. When my husband and I separated, we did the same thing. I was told later that if I had filed it at the court house it would even be more iron clad. ok. so now I know. It only costs about $5 to file something at your courthouse and then you have alittle more confidence in the contract.

THANKS A MILLION FOR UR HELP. U DON'T KNOW MUCH THAT ANSWER HELPED ME. SO IF MY HUSBAND SIGNS ANY PROMISES THAT HE WILL DO IN A PAPER WITH WITNESSES SIGN TOO, IF HE DOES NOT DO IT I CAN SHOW THAT TO COURT AND FILE FOR SEPARATION OR DIVORCE. RIGHT?
THAT WILL COUNT AS A LEGAL DOCUMENT?

Yes. My ex husband signed an agreement with me as far as what he was going to pay in child support and the bills he would be responsible for. He decided to renig on the contract but he saw that paper again when we went to court.

The reason I opted for the notarized separation agreement was because I was not filing for divorce for a few years. I wanted to hit the 10 mark so that I would still qualify for his social security. With out a legal divorce decree, this notarized agreement was enough to protect me from his financial disasters and guarantee me that things would be handled. When he broke the contract and it was time to go to court, my attorney had a copy of the original agreement. It showed the judge exactly what he was dealing with. But be smarter than me, file it at the court house.

Good luck to you. These situations are always so trying.
