Husband in jail, trying to close on my house!

My husband and I seperated, he took the house. He got into drug use very bad, and stopped paying the mortgage. We put the house up for sale, to sell it before they foreclose on it. I finally got an offer and I'm suppose to close before the end of next month. He got himself into a TON of trouble doing illegal things, and they put him in jail. He's looking at a lot of time! Now what? How can I close on the house if he's in jail?


I'm so overwelmed, I don't know what to do!

You will need him to go to the library in jail, or ask his counselor to sign a Power of Attorney, allowing you to handle his financial affairs while he is incarcerated. If he won't do this willingly, you will probably need a lawyer. Talk to your mortgage company, and call your local Legal Aid office. Depending on your income, you could get a free or discounted lawyer, or at least an answer. I've been there. I actually forged his name more than once, but I don't recommend it!

It depends on whose name is on the mortgage, if both he still has rights. If you need to be, go to free legal lawyer and have them help you out with this. Explain everything to them and let them tell you the proper procedures. good luck friend. Blessings.
