Drainage laws property rights

We built our home in 99 and put in drainage around the house consisting of storm sewers and 80 feet of pipe to an open swale. At that time the city told us that anyone in the future using the 80 feet of pipe to convey their water off their property would entitle us to recapture costs. Now a neighbor to the west of us has done just that. We have been told by the city that we can not recapture monies, we do not own the catch basin because it is on the easement. We have other issues that impound our concern besides not being reimbursed. The city won't let us have a copy of the drainage plans for that neighbor. The city says it is "copyrighted". The city let them dig a trench dig without calling JULIE and they hit our water line. report filed with the state and excavator found guilty. Also this trench dig was not village approved and was a deviation from approved plans. Finally, our system has failed due to clogging of a catch basin (final destination) of the swale which has resulted in massive flooding and a back up of water into our detention. Which this neighbor witnessed. We need some representation - we feel our first amendment rights have been violated (can't get drainage plans?) and promises have been broken (village and neighbor). We need to protect our property. They also have raised their foundation 2 feet higher than ours and this we question will add to flooding. HELP?!
