What recourse do we have when a tree is taken down and damages property?

Our neighbor had trees taken down and one fell on our fence. We were out of town at the time and when we returned, the fence had been replaced with a lighter wood. The fence looks awful and is very loose. Furthermore, the gate that once opened from both sides, now only opens from the inside. The tree company is claiming they fixed the fence and they can't afford to have their insurance premiums increase. What rights do we have to force the tree company to do a job that we feel makes the fence "whole"? Should we have our insurance company handle negotiations with the tree company's insurance? Will this have a negative impact on our insurance?

Let your insurance company handle negotiations! thats not a very good excuse from the tree co. they can't afford to have their insurance premiums increase. you need to have your fence whole again and like you had it before. hope this helps.
