Who has child rights?

My son has lived with me all his life. He is 9 years old, there has never been a child support set because we agree to not fight and he is in my presence all the time except 2 nights a week. Last week the father calls me at work tells me he is taking him and dont bother coming to pick him up because he lives with him now. Dont know what to do. Please help with where to start or what can be done. I just want my baby back.

I would go to the courts and file an emergency custody case.

then you would have to start filing for custody and leave it up the judge to decide who gets your son when and who is the main parent now.

Sound like in you divorce decree you have joint custody. In that case you will have to get a lawyer...That being sid you have as much rights to the child as he does. if you were to get him from cschool or such there is nothing he can do either. just move and don't leave a forwarding address. Let him get the attorney. Fight for your child.......what ever that takes
