About child support Payment

My Husband pay child support for another child that he had in the past relatioship but by then we were not married. He owes child support money and the child support took his tax returns. We also had a joint bank account and child support went into our account and frost it and took the money. Know I have my own back account. My question is If Child support finds out that he is married can they take the money out of my personal checking account?

No, the debt is his before you were married so your personal savings can't be attached for his child support arrears. He must pay child support or he can be jailed if the ex persues this through child support enforcement agencies, so the best course is for him to contact the court ordering support and petition for modification if it is set at a rate he is unable to pay; ordinarily if the non-custodial parent can show a change in earnings the court will adjust the amount.

Even if you are married, you are not responsible for his child support debt. They cannot seize your portion of the Tax Return, or bank account, even if joint.
