Adultery is legally defined as having sex with someone who is not your spouse. Given that, you can see how "interpretations" of "sex" have changed over the years. Just ask Bill Clinton. Still, ini a court of law; adultery is generally regarded as sexual intercourse. You might also be interested to know that in many states, adultery is either no longer a crime or no longer prosecuted even though it is still on the books as a crime.

Are we looking for a loophole? Adultery is actually not limited to intercourse. Any act of infidelity is considered a breach of trust. You can actually be considered in an adulterous relationship, if you are getting your emotional needs met by someone else, using the term - emotional adultery. The danger here is that the bonds of your marriage are being strained and instead of seeking the company, comfort, or whatever else you think you need you are going outside your marriage. This is a symptom of something possibly wrong in your marriage. Could be you, could be him, or both of you. Stress both good and bad can hurt a marriage, having a baby, change of jobs, buying a house, even winning the lottery. So if you have done anything, you must go to your spouse, and try to work things out. If you are no longer in love, though I personally hate divorce (except in cases of abuse), leave. Good luck, Susu
