Texting threats

Bad situation! my married son had affair with married friend. The mates found out. The husband came over and hit my son in the head and has continued to text threatening messages to my son's cell phone.
my son did not go to the police about the physical, should he file a report about the physical and the texting threats? if so, what is he suing for?

I'm not completely sure what he should be suing for, but perhaps something to deal with harassment. I do know that he should report it to the police as harassment, especially if he keeps those texts on his phone along with the return number. Any type of harassing calls or texts can be reported to police and they will deal with it.

He's not suing for anything, unless its for the financial harm caused by a head injury and the texts.He could solicit the help of the police to stop the threatening texts and probably file charges for the physical injury if he feels threatened.

Filing a police report is different from suing someone. I get the idea that you know how to fill out the police report; then if he wants to sue the guy (if, for instance, he has suffered injuries) then that is a different matter. If he decides to sue he should contact an attorney.

Go to court and get a no contact order. usualy you can get one for 90 days and if the guy continues to sent texts, he will be sent to jail.

Tell your son to contact his phone carrier aout the threats. The FCC in its rules states that anyone who sues a cell phone or other cimmunication device for the sole purpose of threatening or coercion can have his phone turned off and supended from phone service for an indeterminable amount of time. Tell your son that he's lucky. People have been know to catch a bullet for such behavior.

He is not suing more jus have a police report in case nething else were to happen.. they have proof that he already went to the police... He might be able to get a restraining order against the guy as well...

Sue the man but also go file for a protection order threw the juvinile court house. bring phone with u to court bring medical forms bring police report and that judge will settle the fines the man must pay right then in 2nd court hearing. you will have one hearing the day u file that is for the judge to decide if there is a protection order needed. 4788Angel
