Can my husband's ex-wife not allow me to pick up their daughter from daycare?

I live in New York State. My husband and I have been married for about 3 months now. The child agreement says that he has her on Tuesdays, Thursdays and Sundays. My husband is now coaching during the week, so he can't pick her up from daycare by 4. The plan was that I would get her and hang out with her until he got home. His ex-wife called daycare and said that I cannot pick her up... can she do this?

I dont know about your state but in tennessee there has to be a list of people on file of who can and can not pick up a child from school or daycare. So i guess the answer to your question is yes she can

Unfortunately she can do this unless something in the divorce paperwork states that either the Father or Step-mother have the right to do so. If she is going to play hardball and not look out for the best interest of the child then you will have to go back to court to get this corrected. In most states you can ask for a modification and have this handled through a mediator so there isn't a large expense involved. Your husband should send her an email requesting that you be allowed to pick the child up prior to contacting a mediator. If she replies with a no then he will have grounds to proceed with court action.
