Court ordered visitation

We had a court order set in place september 2007 and expiring september 2008. The order was issued for every other weekend Sat. morning until Sunday afternoon. I'm the physical sole custody parent. What are my legal rights here? The father and i have little communication, he has past criminal record along with domestic abuse. He recently as of February had a violation with a domestic assault with his girlfriend. He currently lives with her.

He now wants to have the children (5 & 7) every other weekend starting on Friday nights through Sunday afternoon. He also is stating that i provide clothing for them on his weekends.

Since the court order expired last year and his vistation rights have not be renewed (his responsibility) he's really out of luck to dictate any terms. Is he paying child support and is he current? If he's current, like lissa said, he's going to have to ask for an order of modification. If he does, you can bring everything up including hgis latest escapades with the law and the fact that he isn't going to support the kids when he does have them. Until the court says something, you're in the driver's seat. PS Don't tell him he goofed by not getting the first order extended. It's a lot more fun when a judge tells him.
