If there are no custoday papers does the mother of the said children have sole custody

If the mother and father were never married and there aren't any custody papers in the state of MI does the mother first have sole custody and second can she move out of state (i.e TX)?

You never have sole custody until a court syas so. That being said, you are free to come to Texa from Michigan but the father is also free to file for custody. However, in doing so he will be subjected to child support and a parenting plan before a court considers his request.

Don't get me wrong I get along w/ the father, but he really does not put any effort in. Now that being said, doesn't mean I think he is a terrible father, and I have specified this to my daughter when she complains about having to do house work and tend to the kids. Well, she doesn't work as many hours a day that he does or for the week, nor does she make as much as him. And the stupid town she lives in is BEDROCK.... the woman's place is in the house and to speak when spoken to. And I didn't raise my child to be like that. Now with what you said, my understanding of the matter goes back to when my children were little and I too was a single parent, their father wasn't on their birth certicates as their dad, and he didn't pay child support, nor did he see them on a regular basis. I was told from a family friend (lawyer) that he had no say on where were lived nor could he fight it.... Because he owed child support to me, and really had no legal claim to my children until praternity was established. Now once that was done he could try, but didn't becasue of all the back child support he owed. My kids are now 20 and 17 - and two of the best kids you could ask for coming from a single parent household. LoL I had to throw that in...LoL But anyways, I have told the father he is more than welcomed to come and visit and vice versa. But my daughter's biggest fear is that his mommy and daddy will once again pay any legal fees for him. And since there is no custody papers or said custody I always thought and was told until that happens the mother that gave birth to the child is the SOLE CUSTODIAL parent?
