My ex wife lives in our house.we have been divorced for a few years and i have always soley paid the mortgage.she is on income support and my 7 yr old

Paid the mortgage.im now remarried.my ex wife is on income support and lives with our 9yr old daughter.ive met someone new and need to sell the house to buy a bew one with my new partner.the house is soley in my name.can i sell it?

It depends on what was stipulated in your divorce.

If the house, is yours...solely yours and she has no claim or right to it anymore, in any way..and your exwife and daughter live there as "tenants" then yes you can sell it. Otherwise, no....you have to go by what the divorce orders were.

Be careful with this. The impacts of putting your ex-wife out in the street may not matter all that much to you....but be aware of the effects this will have on your daughter. Her schooling, her friends, her life. You are talking about uprooting her from the life she knows. After going through everything with the divorce, is this really something you want to do to her? That's a question only you can answer, and will have to live with.
