Child support

My husband and I have been married for 5 months he got this letter for paternity test? what I want to know is, his not working, the only income is my disability and my daughters child support, can the so call mother of the child get child support from the income that I get?

Depends on the state you live in but in Oregon the law is that a new wife is NOT held liable for the husbands child from a relationship prior to you two being married, that being said if the child is his he does have to pay child support which will be placed in rears and when he does get a job they will garnish a percentage of his wages plus what he is to pay monthly, But he SHOULD pay child suport as he did make the child with her and it shouldnt be left to her to suport his child by her self, I hope it all works out for you and your husband

Also, if you and your husband do not file joint tax refunds, then your earnings are considered separate and therefore is not considered in any court preceedings regarding a child he had before, or outside of your marriage.
