How can a guy sign off his rights to his child?

My son's dad wants to sign off right to him because he doesn't want to pay child support. How can and why can someone do that. They made that kid too.

I dont think he can just do that unless you're both in favor of it, but I'm not certain. You may want to try your state website. (I'm in California so its www.ca.gov) so you can get the correct info. If you are in need of the $, then it's in your best interest that he doesnt sign off his rights. If you'd rather do w/ out the money so long as you dont have to deal w/ him & he doesnt have any rights over the child, then i'd go for it. YOu have to think unless you've gone to court to determine legal custody, you both have the same amount of rights over the child. Heaven forbid, but if you die, that man has all rights over that child and can make all choices for him/her until they are 18. Vice versa, if he dies, your child would have access to any SS benefits. Its a big deal, so I suggest you really think about it and really talk it over.

I don't know about where you live but in Ohio you can not just sign off on your child. If you were never married and never went to court to establish custody then he has no rights until he does so. My husband just adopted my daughter from a previous relationship because of the same situation. Her dad wanted to terminate his rights, we looked in to it and our attorney told us he never had any so there was no way to sever rights that were never established. Although, my husband has adopted her it does not free my ex from the back child support only his current obligation (although I am choosing to sign off on what he owes me. I don't want anymore ties to the creep). It is heartbreaking but I have told my ex that once he gets his life straightened out and if he chooses so he may see her in a supervised visit with my husband and me present. The only victim here is our child although he maked himself out to be an individual that just can't support her. At least now I know the ball will always be in my court and she will always be safe and protected...good luck.

The only way he would be allowed to sign away his rights is if you were in agreement to it to get him out of your life or if you were involved with another man who wanted to take over as the legal father. He cannot just "sign" away his rights.

In the state of Florida, my grandson's father had to take a court ordered test to show that he was the father. When the results came back 99.999 positive, the father then asked the judge what it would cost him to never see his son- ever. The judge answered it'll cost you big! And it did. He pays max child support and is never allowed to see or be near his son. Of course he has never even tried anyway. Baby was 2 months at the time, they were not married, and my wonderful grandson is now almost 11 years, and has a wonderful father whom my daughter married when he was age 3 that adopted him and he knows and loves him as DAD.

I've recently went through this experience. They cannot sign over their rights unless you agree and then they have to have someone to sign them over to. Such as if you get married and the person you're with wants to adopt your child as his own. However, laws vary from state to state. I live in Indiana and that's how it is here. He is required to pay child support unless you agree to let him sign over rights.

I was adopted when I was three months old to a wonderful couple who couldn't have children. When I was twenty-one when we were reunited and, thats another story in itself. I met sixty-five people that I was blood related to, it was the best day of my life. My older brother Kevin is missing some much needed red blood cells and is specially challenged as I like to put it. We share the same dad and, he is older than me. When I realized that he didn't want to meet me I was bummed out until I heard the entire story. My "real" father told (my biological mother) Libby when Kevin was around five he noticed that he was special. He told her that if she didn't let him sighn away his rights that he would have Kevin put into a mental facility as his parental guardian. Of coase she agreed and, still takes great care of him to this day. Even now when Kenny Perkins (his "dad") drives down the roads in Frankfort, Kentucky in one of his many tow trucks that he owns he still refuses to wave back to Kevin every time. Some guys are deadbeats who only care about themselves and, those guys don't deserve loving children. If your boyfriend wants to terminate his rights then let him do it. You can still discuss child support with a lawyer and, take him to court but, I think the decision of him still continuing to pay differs from state to state. You will find someone better when you are not even looking and I guarantee he will make a better father than you ever thought your child would have. Having a baby doesn't make a guy a father. Loving, raising, providing, and protecting a child makes a man father

Talk to a lawyer at a free or low-cost legal clinic. If the child's father has wages, in most states the child support can be taken directly out of his paycheck and sent to you.

While the answer is subject to the laws of the particular state of the parties' residence, in general, the right to visitation and the right to support can be waived. Notwithstanding the waiver, it would not be difficult for the waiver to be reversed, and a support obligation be revived.
