How to get a lien against property

Wind damaged the fence between my property and the property next door, which is in foreclosure. The previous owners have moved out of state and cannot be served for a small claims case. Can I sue the beneficiary trustee listed on the property tax records for half the value of the fence and win a judgement? Can that judgement be turned into a lien against the property?

I am wondering why you feel the urge to sue anyone over damage caused by a wind storm? Maybe you just need to let the foreclosing bank know there was damage and find out if they plan on helping pay the cost of repair.
