How can I get my money or my merchandise?

I ordered merchandise online on May 2, 2008 and I still have not received it. I emailed the merchant several times with no reply. Finally, when I threatened to take her to court, she answered. She apologized for the inconvenience and promised to send me a refund on June 4, 2008. It is now June 29, 2008 and I have not received the refund. I have, however, received another email from her saying that my original merchandise would be shipped on June 19, 2008. I have not received the merchandise. Even when I use the tracking number she sent, I cannot find that the package has been shipped. The cost of the merchandise is only $58.16, but it's my money and I want IT back or the merchandise. The website does NOT furnish a working phone number or an address. I live in a different state than the merchant. As a matter of fact, I don't know exactly where the business is located. They indicate Florida, but when I search in Florida, neither the business nor the individual that runs the business shows up. The website looks very professional and she is also the designer and web mistress of another website. I don't know if I'm being stalled until she can figure something out or if I'm being ripped off. What can I do? I would like to take her to small claims court, but I don't want to spend lots of money to get back $58.16. I would also like to have her arrested, disgraced, put out of business or taken to one of those TV courts. I'm just angry that she pulled a fast

You may just have to count your losses because taking her to court wil cost you upfront. Although since you have EMAILs from the merchant, you do have a case, and she could be required to pay the court costs if you can get her into court. The problem is proving who she is exactly. Caveat emptor means buyer beware, that is a hard lesson to learn. You may actually find that her EMAIL address no longer works, but a Private Investigator may be able to help you get info on who the website is registered to as well as the EMAIL address.
