Purchases by check

I ordered some puzzle books in July 2008 and sent a check for the payment. The company cashed my check on July 21, 2008. But I have never received any books! I have called several times to check on my order. Once I was told that they'd send another order, which I never received and then I was told that they'd send one book at a time, which I've never received either! Two weeks ago I called and said I wanted to cancel my order and would like my money back! After speaking with a "supervisor", I was told that it would take 12 weeks to get my refund! Is this right?

Also, when a company cashes your check, don't they have to ship your order within a certain time...like 48 hours?

They've had my money since July and now they say that I have to wait until December to get my refund!

What should I do? Thank you for any help you can give me.
