It depends which state you are in. Most states say you must be 50 yards from any road way and outside the corp. city limits to hunt. Some states will make an exception if the animals are being destructive, but
it would require a permit. Chances are if you called law enforcement you could get it stopped. My suggestion would be to take a picture of him doing it then call the law. You have nothing to lose and a squirrel's life to gain by doing this.
