Childsupport/taxes

The child lives with the bio mom and maternal grandmother, father pays 83% of childs living expenses including 100% medical and child care. The mother has not worked at all this year but is allowing her mother to claim the child so she can get money back? Is this legal can the father fight this?

I was a Child Support worker for 9 years, yes that is legal for the child's grand mother to be able to claim the child since the child has lived in her home all year, and is dependent on the grandmother since the mother is not working. Now you can take it into court and have a court order drawn up that you claim the child every other year. I'm not sure where you live but you may want to check with the court system/ child support division there or call an attorney about it.

My ex-husband is supposed to pay me childsupport but doesn't pay it at all he said being he gets the kids half and half he doesn't have to pay me anything and he has a savings account for them if they need anything but I don't have access to this account, his child support is only a whole $72 a month, and he also files taxes on one of our kids, he files head of house hold on them as well, I am the primary care giver for them their home address is mine where they have always lived, but I feel he souldn't be able to file taxes on them until he is up to date on his support, can I have something done about this, it's in our divorce papers that unless he is up to date with his support that he can't file on them, I spoke to my lawyer and he said I'd have to take it back to court, what should, and can I do.

First, Check your court order. Does it show that the tax claim shall be divided between the 2 parents? If not & the grandparent is supporting the child, its not against the law. You can go back to court & have that put into a court order. My current order shows my ex claims my daughter on even years & I claim her on odd years (only for depended purposes). I ALWAYS get the Earned Income Credit because she lives in my household.
