Are you filing jointly or separetly?

Your husband can't "claim you" like you claim a dependent. When you are married you either file a joint return or a seperate return. If you haven't signed a joint return then you did not file together. If he's your husband ask :)

I am still married and husband and i have been on bad turms so i cannot ask him. is there a possable way he can claim me before i file my taxes? when we lived together as man and wife he would do our taxes and claimed me with out me being present. ive just astablished myself as of 14 months ago with a job and life of my own and yet there is a matter of devorice that will take place soon, he has temperarly gain custody of my 2 children and im told i better not claim then iv had them sence biert up until 5 months ago so this is my first time i file taxes after 24 years of marrage and taken care of always, money talks thats for sure and hes doing all the talking these days please give insight. on this matter knoloage is a good thing in this area i have none. i was a doll in the cubord he did everything and he wanted control of everything he did taxes every year.

If you had the child for months and he had them 8 months, then he would get the deduction
