I have been sapareted from my kids father for 3 years. Last year i have filed with both our kids, and he did the same thing. But the kids are not staying with him. I have living with them. How will that effect my tax filing. Will i owe the IRS money back?

If you have no written agreement between you about who can claim the children, then the IRS will always side with the custodial parent.

You may find yourself faxing them pages of proof about where the children lived. If you get any letters from the IRS, respond to them as quickly as possible.

If the kids are not living with their father, then he is cheating on his taxes and he will be in trouble with the IRS.

Be prepared with written proof that the children lived with you, and you should be fine as long as you respond promptly to any IRS questions.
