Optional business standard mileage rate?

I need to know how this works? If an employer paid their employees mileage but didn't pay the new rate 58.5 cents a mile can they still deduct that amount from there taxes? For ex: If an employer paid there employers the 50.5 cents a mile instead of the 58.5 cents a mile because they was not aware that it went up in July can they still deduct the 58.5 cents a mile or can they only deduct the 50.5 cents a mile?

If they are an employee, they can't deduct anything on taxes, as they are an employee.

the fact the employer paid it is cool, and i wouldn't worry about that extra 8 cents a mile.
