Can i get in trouble for chainging my status of filing taxes?

I have filed joint for the last 5 years and would like to file head of household for 2009. can i get in trouble with the irs for it?

When you filed a joint return you had to put down a name and SSN. If it was a husband and you're divorced, have children, then you are head of household. If you will living with someone and used their SSN as a spouse its okay if your state recognizes common law marriages, if not you have to file an amended return. One of the items the IRS computer system checks is the SSN for a few things: Is it a legit number, is the number's owner alive or dead, had activity on the number to generate a W2 or 1099. It is not unusual for the IRS to be about four years behind but they will check eerything on a return. The instructions on the 1040 tell you what your filing status is, just read and answer their questions.

Yes, if you could file HOH IN THE PAST WHY HAVEN'T YOU FILED HOH BEFORE.

Filing status is a limited choice based on your marital status (and whether you live with your spouse), and whether or not you have qualifying dependents.

I've often had single people with no children tell me they were Head of Household -- and they *are* the head of their household, but that is not their filing status for tax purposes.

If you're married and living with your spouse, your choices are Married Filing Joint or Married Filing Separate.
If you're married but didn't live with your spouse after June 30, and you have a qualifying dependent (usually your child), your choices are MFJ, MJS or Head of Household (HoH is usually the more favorable).
If you're single or divorced and have a qualifying dependent, your choices are Single or Head of Household (HoH is the more favorable).
If you're single or divorced and don't have qualifying dependents, your only option is Single.

You can get in trouble if it's not true. But you can change it any year that your situation changes.
If your husband has not lived in the house for over 6 months, AND you have kids or other dependents living with you, you can file HOH. If he has lived with you over 6 months, you have to file married (joint) or married filing seperately.
