Have been in the same predicament so I am answering this question from first-hand experience. They can, and WILL take your return - as the previous poster stated, they may not "know" about it yet. It took the IRS about two years after defaulting to start withholding my tax refund, however a good friend of mine's was withheld almost immediately. I know it is a scary situation to be in, especially when you need the money and don't receive it. Depending on how long it has been since the loans went into default is really the biggest factor. If it just happened this year chances are good that you will still receive the refund - but don't expect to get it back next year unless you make some type of payment arrangement.
