Firing a gun

Late at night a friend of mine (Tom) was waken at 2-3:am by his dog barking. A few weeks before he was attacked by 4 guys at his place of work he reported it too. So he armed himself, went outside.Yelled a few times someone said I got your bitch. Samething that was said when he was attacked at work. He fired his gun towards the woods to the right of any sound he heard, went back inside. Next day 4:pm officer came over , he told him his story.A few hours later he was arrested for unlawful use of firearm. Neighbor claims it was his son with two friend that were fishing in pond with hardly any water in it. they were scared to death ran back to house. There are 3 fences, running in dark not one ran into the fence. And one of the boys stories is way different from the others. They want to give Tom 5 years probation and take away his use of a gun. forever!? He loves to hunt and I know he wouldn't shot a gun towards any houses. Is there anything he can do????

If it's his 1st offense they might go easy on him, can he afford a lawyer? He might be able to convince the DA that he's safety conscious. Maybe he could take a gun safety class. Probably doesn't need it but it might show the courts that he's willing to be more considerate, he's lucky he didn't shoot one of the kids.

They may reduce the sentence so he can hunt again someday, but the police officer is right - you cannot just shoot a gun into the darkness like that. There was a story recently in Denver where I am, on New Years Eve someone shot a bullet into the air, innocent enough and the stray bullets came into a neighboring house and killed a 10 year old little girl and her aunt.

He can hire a lawyer for advise thats the best thing to do. they will railroad you back and forth unless you know the law. and any ways they cant do that on his property. and the thing about the boys story what the hell were they fishing at 2-3 in the mornin for thats bull they makin it all up and you can prove it if you can afford a lawyer. people suck and do shitty thangs at times keep fighting an eventually your can win.

Hire lawyer take pictures of pond and get transcripts of other boys statements the truth will set him free

This one is a little dicey.

A) The issue of the attack before will help. (he does need a lawyer).
B) I say B.S. if he's an avid hunter HE FREAKIN KNOWS BETTER!.. Thus helping his defense.
Assuming he is under 40 years old. all or most states REQUIRE gun safety courses in order to obtain a hunting license.
Down side, he should have called the cops upon the incident.
As for the neighbor... "little Billy" was fishing at 2-3 am?
Daddy has control issues, and is overcompensating.

Well you need to go through hunters safety to even hunt and you need a permit to carry a fire arm in public and like k_st8r said anyone should know better than to just fire into the woods and anyways if you did injure its sounds wrong but kill them all the way to avoid a lawsuit and if the family sues you say he was threatening you and it was harrasment

and who goes fishing at 2 inth morning sounds like kids trying to be funny
