There are four general categories of felonies in Utah: capital felonies, first degree felonies, second degree felonies, and third degree felonies. Capital felonies are punishable by death, life in prison without the possibility of parole, or a prison term of 20 years to life. First degree felonies are generally punishable by a prison term of 5 years to life and a fine of up to $10,000. While the maximum prison term for first degree felonies always remains life, the minimum term varies and may be 3, 5, 6, 10, or 15 years depending on the crime. Generally, the prison term for second degree felonies is 1 to 15 years and the fine can be up to $10,000 while the prison term for third degree felonies is generally 0 to 5 years and the fine can be up to $5,000.
There are three categories of misdemeanors in Utah. Class A misdemeanors are punishable by up to 1 year in jail and a fine of up to $2,500. Class B misdemeanors are punishable by up to 6 months in jail and a fine of up to $1,000. The punishment for Class C misdemeanors is up to 90 days in jail and a fine of up to $750.
