Can a american citizen that went tocancun mexico sue the hotel for negligence

I went to cancun mexico on 5-07-08 and stayed at the hyatt regency. On 5-10-08 i started getting sick and on 5-15-08 i had to leave due to the fact that the water from the shower got in my eye and caused a serious infection in my left eye so severe that i had to leave cancun immediately to receive treatment at home before i lost sight in my left eye. The bacteria that got in my left eye spread to my whole body which made me deathly ill and i couldnt hold down any food water and etc. On 5-15-08 i was so sick that my daughter in law had to get me home because she didnt know if i would live or not. The hotel told us not to brush our teeth with the sink water which we did not do. I did not go swimming or even go into the ocean. I have pictures from my digital camera showing what i looked like before i left cancun. I have been treating this condition since 5-15-08 till now. Would you please let me know if i have a case to prove the hotel negligence because of the bacteria in the water. Thank you sally montgomery

This is a situation where you need to get a lawyer and sue the hotel for your expenses! I am not a sue-happy person, but there are circumstances that warrant a lawsuit and this one certainly does. Gather your medical bills, travel bills, and photos and go to an injury lawyer right away. Some injury lawyers will take on a case at no expense to you until you get a settlement and they take a portion of that. Good luck!

THANKS FOR RESPONDING SO FAST TO MY QUESTION. I OWNED MY OWN INSURANCE BUINESS FOR 13 YEARS AND I THOUGHT I KNEW SOMETHING ABOUT THIS BUT I GUESS I WANTED SOMEONE ELSE'S OPINION. IM NOT A SUE HAPPY PERSON EITHER BUT I THOUGHT THIS SITUATION WARRANTS ME COMPENSATION. MY EYE IS DOING BETTER BUT NOW MY RIGHT EYE ALSO HAS TO HAVE A CONTACT IN IT. THE INFECTION GOT IN IT AND I CANT SEE OUT OF THAT EYE FAR WAY LIKE I COULD. DO YOU HAVE A LAWYER IN MIND AT ALL FOR ME. I LIVE IN WENATCHEE WASHINGTON AND IT IS A VERY SMALL TOWN. ANY ADVICE WOULD HELP ME OUT IMMENSELY. I CALLED A LAWYER IN WENATCHEE AND HE REFERRED ME TO SEATTLE OR SPOKANE. THANKS AGAIN FOR THE ADVICE. THANK YOU SALLY

Its in mexico, and you knew the water's risk going into it.

i don't know if you would be able to have much of a case.

I knew that you cant drink the water or brush your teeth with the water. The hotel stated to me that they had a purification in the hotel which i would assume that the water that came out of the shower would not have bacteria in it which caused the bacteria to get under my contact and cause all these problems. We did use the ice cubes to make our coffee and brush our teeth which if this is the case why didnt they make me sick?Nothing was posted in the shower stating that it wasnt safe to take a shower because otherwise i wouldnt have taken one. People that are staying at this motel should have been warned regarding the shower water. Im assuming that the hotels water purification system was not working properly. If it wasnt this its the hotels responsibility to post this so we dont have this problem. While in mexico my daughter in law and myself bought alot of bottled water and also brought some back to the hotel. We did everything we could to avoid drinking any water from mexico at all. It was the bacteria in the shower water that caused this! sally montgomery

I agree that this tends to be a safety hazard and a big hotel chain needs to take more precautions to have safe water. Of course when you go, you know not to drink the water, but as you stated above, there was no way you could have known the shower was safe. When it comes to an issue like this where you could have lost your eye, not only do I believe that a lawsuit should be placed against the hotel for YOUR medical bills and to compensate you, but the hotel needs to make some sort of change to protect other guests. Even if it is as simple as posting notes to warn people.

I feel for you and I can't imagine what that was like, but I agree if their water system is not working correctly, then they need to be forced to make it work properly or who knows how many people it could hurt. Good luck!

Thanks for the input. I totally agree with you about the hotel. This wouldnt have been so bad but im a very small person and something like this could have cost me my sight and my life if i hadnt got out of mexico when i did. The bacteria hit my system so hard because i am tiny that i could have had major problems if i hadnt got out of cancun when i did. Im still on nausea pills just in order to keep my food down. I cant afford to lose anymore weight and go thru the stress of worrying if im going to have more problems in the future. Thank you sally montgomery
